1. Introduction

The online shop oujo.ch is operated by Ritter Products AG. “oujo.ch” refers to the web shop as well as the products and services offered through it.

2. Scope of application

These Terms and Conditions apply to all offers, products and services provided by Ritter Products AG to private customers (B2C) and business customers (B2B) in Switzerland and in the EU, provided that deliveries to the EU are offered.

Any differing terms and conditions of the customer shall only apply if they have been expressly confirmed in writing by Ritter Products AG.

3. Product information

Ritter Products AG strives to publish product information that is up to date, complete and correct. However, many details are provided directly by the manufacturer. To the extent permitted by law, no warranty is given for the accuracy of such information.

Technical changes, errors or misprints are reserved.

4. Prices

  • All prices are stated in CHF.
  • Switzerland – private customers: incl. statutory VAT
  • Switzerland – business customers: excl. VAT
  • EU customers (if delivery is enabled): prices are stated excl. foreign VAT. Any taxes, customs duties or fees in the destination country shall be borne by the customer.

Price changes and corrections are reserved.

5. Conclusion of contract & cancellation

The products and prices published in the web shop constitute a binding offer.

By completing an order, the customer submits an offer. The contract is concluded as soon as the automated order confirmation is sent. This confirms receipt of the order, but does not guarantee delivery.

Cancellations by customers:
Not possible unless accepted by Ritter Products AG.

Incorrect price information or impossibility of delivery:
The contract may be rescinded. Amounts already paid will be refunded. Title reverts to Ritter Products AG if the goods are already with the customer.

Retention of title:
The goods remain the property of Ritter Products AG until paid in full.

6. Availability & delivery

Deliveries are made exclusively within Switzerland to the curbside. (No deliveries to upper floors.)

Availability indicator:

  • Green: 2–3 days
  • Yellow: Few items left, 2–3 days
  • Red: Currently not available

Delivery delays due to manufacturer issues or stock discrepancies are possible.

Customer obligations:
Products must be inspected immediately. Defects must be reported within 10 days.

Transport damage:
Ritter Products AG accepts no liability.

7. Shipping costs

  • From CHF 100.–: free shipping
  • Below CHF 100.–: CHF 9.90

8. Payment terms

Accepted payment methods:

  • VISA
  • Mastercard
  • TWINT

The customer is obliged to use the selected payment method.

9. Late payment

In the event of late or missing payment:

  • immediate stop of delivery
  • termination of the contract after 10 days without response
  • from the 3rd reminder: CHF 20.– reminder fee
  • handover to a debt collection agency from the 3rd reminder

10. Exchange & returns (30 days)

Returns are possible within 30 days if:

  • the product and packaging are in perfect condition and fit for sale
  • you have contacted us in advance by e-mail

11. Returns of goods

Returns will only be accepted after written approval by Ritter Products AG and at the customer’s cost and risk.

Requirements:

  • original packaging (undamaged)
  • complete return shipment
  • description of the issue & proof of purchase (invoice)

Incomplete or damaged returns may be rejected.

12. Data errors & liability

To the extent permitted by law, Ritter Products AG accepts no liability for data errors, incorrect price information or accidentally incorrect product information.

13. Data protection (Swiss FADP & EU GDPR)

Ritter Products AG complies with the applicable statutory data protection provisions:

Switzerland
In accordance with the Federal Act on Data Protection (FADP).
EU / EEA (if applicable)

When processing data of EU customers, this is done in accordance with the GDPR, in particular:

  • right of access
  • right to rectification
  • right to erasure (“right to be forgotten”)
  • right to data portability
  • withdrawal of consents

Personal data is not shared with third parties unless this is required to perform the contract (e.g. logistics, payment service providers).

Extended Producer Responsibility (EPR) – France

Where legally required, Ritter Products AG is registered in France under the Extended Producer Responsibility (EPR) regime.

14. Right of withdrawal for EU consumers

(Only relevant for deliveries to the EU)

EU consumers have a statutory 14-day right of withdrawal without stating reasons. The period begins on the day the customer receives the goods.

The following are excluded from withdrawal:

  • used or damaged products
  • unsealed hygiene products
  • customised/configured goods

Return shipment is at the customer’s expense.

15. Warranty

Switzerland:
Warranty in accordance with the Swiss Code of Obligations (CO).
Duration: 2 years, unless stated otherwise.

EU (if delivery is offered):
Warranty period in accordance with EU consumer protection: 2 years.

16. Governing law & place of jurisdiction

Swiss law shall apply.
Place of jurisdiction for all disputes: Olten SO, Switzerland.
